The agreement between you and K&Y, Inc. DBA DTF4Prints when you use this website or place an order with us.

These Terms and Conditions (“Terms”) govern your access to and use of dtf4prints.com and any order you place with K&Y, Inc. DBA DTF4Prints (“DTF4Prints,” “we,” “us,” or “our”). By accessing this website, placing an order, or using any service we provide, you agree to be bound by these Terms. If you do not agree, you may not use the website or our services.

Please read Sections 8, 15, and 19 carefully

Section 8 explains that you are responsible for the rights to, and the accuracy of, the artwork you send us. Section 15 limits our liability. Section 19 sets out how disputes are resolved and where.

1. Who we are

This website is operated by K&Y, Inc. DBA DTF4Prints, a California corporation with its principal place of business at 7379 Orangethorpe Ave, Ste C, Buena Park, CA 90621. “DTF4Prints” is a fictitious business name of K&Y, Inc. Any contract you enter into through this site is with K&Y, Inc., and every reference to “DTF4Prints” in these Terms means K&Y, Inc. trading under that name.

2. Acceptance of these Terms

By using this website or placing an order, you confirm that you have read, understood, and agree to comply with these Terms and with all applicable laws and regulations. These Terms apply alongside the policies referenced in Sections 10 and 11 and our Privacy Policy, all of which form part of the agreement between us.

3. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately if you believe your account has been accessed without your permission.

4. Acceptable use of the website

You agree to use this website for lawful purposes only. You may not use it in any way that could damage, disable, overburden, or impair the site, interfere with another party’s use of it, or attempt to gain unauthorized access to any part of the website, to any account, or to any system or network connected to it. This includes scraping, automated bulk access, probing for vulnerabilities, and introducing malicious code.

Unauthorized use may result in termination of your access under Section 17 and may give rise to civil or criminal liability.

5. Products and services

We produce custom Direct-to-Film (DTF) and UV DTF transfers to order, and we sell related consumables and equipment. Custom transfers are manufactured specifically for you from the artwork and specifications you submit. They are not stock items and have no resale value to us if you decline them, which is why the cancellation and refund rights in Section 11 are limited.

6. Orders and acceptance

By placing an order you represent that all information you provide is accurate, current, and complete, and that you are authorized to use the payment method submitted.

Your order is an offer to purchase. An order confirmation does not constitute final acceptance. We accept your offer when we begin production or ship the goods. Until then we may refuse, cancel, or limit any order at our sole discretion, including where we suspect fraud, where a price or listing is in error, where an item is unavailable, where artwork violates Section 8 or our Content Standards, or where the order otherwise conflicts with these Terms. If we cancel an order you have already paid for, we refund it in full.

7. Pricing, errors, and taxes

All prices are in U.S. dollars and exclude applicable sales tax, which is calculated at checkout based on your shipping destination. We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been submitted. Where a product is listed at an incorrect price we may either honor the displayed price or cancel the order and refund you in full. Prices, product descriptions, and availability may change without notice.

Tax-exempt and resale customers must have an approved exemption on file before ordering. See Tax Exemption.

8. Customer content and artwork responsibility

If you submit artwork, designs, logos, or other materials (“Customer Content”), you represent and warrant that you own it or hold all rights, licenses, and permissions necessary to reproduce it on the products you have ordered, and that it does not infringe the intellectual property, privacy, publicity, or other rights of any third party.

We print your files as submitted

Artwork is printed as provided. We do not modify, correct, resize, recolor, or enhance Customer Content unless you request it and we agree in writing. You are solely responsible for verifying that your files meet all specifications before submission, including resolution, transparency, color format, dimensions, layout, spelling, and overall accuracy.

If we spot a problem, we will usually stop and tell you — but that is a courtesy, not an obligation

As a matter of practice we try to flag files that we believe will print poorly and contact you before proceeding, because we would rather delay an order than send you something you will reject. We cannot guarantee we will catch every issue, and nothing in this practice shifts responsibility for file accuracy from you to us. Where we do contact you, production begins when a usable corrected file arrives, which may move your order past the same-day cutoff.

Licence and ownership

You retain ownership of your Customer Content. You grant us a limited, non-exclusive, royalty-free licence to reproduce, store, and where necessary resize it, solely to produce and fulfill your order, to provide reprints, and to fulfill repeat orders you place.

Rights we will not print

We will decline any order we believe infringes a third party’s rights or violates our standards, at any point before shipment, and we refund such orders in full. See our Copyright Guidelines and Content Standards. Technical specifications are set out in our Artwork & File Requirements.

9. Print quality and color

Output quality depends directly on the file you supply. Screens display color differently from printed transfers, and some variation between your monitor and the finished product is normal and is not a defect. Ordering a small test quantity before a large run is strongly recommended and is the single most effective way to avoid disappointment on a large order.

10. Production times, shipping, and pickup

Production time is the time we take to make your order before it ships and does not include carrier transit time. Our same-day production cutoff, shipping methods, free shipping threshold, and local pickup terms are set out in our Shipping & Pickup Policy, which forms part of these Terms. Risk of loss passes to you when the carrier takes possession of the package. Delays are addressed in our Production Delay Policy.

11. Cancellations, refunds, and returns

Because custom transfers are made to order, cancellation and refund rights are limited and depend on where your order is in production. The following policies form part of these Terms:

12. Intellectual property in our website

All content on this website other than Customer Content — including text, graphics, logos, images, designs, layouts, product descriptions, photography, and software — is the property of K&Y, Inc. or its licensors and is protected by United States and California intellectual property law. No such content may be copied, reproduced, distributed, modified, displayed, or otherwise exploited without our prior written consent.

13. Third-party links

This website may contain links to third-party websites, including our sister store heattransfervinyl4u.com and our social media profiles, provided for convenience only. We do not control and are not responsible for the content, policies, practices, or availability of any third-party website. Accessing them is done at your own risk and is governed by their terms, not ours.

14. Disclaimers

Our products carry the express remedies set out in our Refund & Reprint Policy and Satisfaction Guarantee. Except for those remedies, and to the fullest extent permitted by California law, all products, services, and website content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the website or our services will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected.

15. Limitation of liability

To the fullest extent permitted by law, K&Y, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, lost business, event costs, or business interruption, arising out of or relating to your use of the website, products, or services, even if advised of the possibility of such damages.

In no event will our total aggregate liability exceed the amount you paid for the specific product or service giving rise to the claim.

Blank garments and substrates

We supply transfers, not finished apparel. We are not responsible for the cost of garments, tumblers, or other substrates damaged during application, and we have no way to verify their value or origin. Test on a sample from the same batch before pressing a full run.

16. Indemnification

You agree to indemnify, defend, and hold harmless K&Y, Inc., its owners, officers, employees, affiliates, and agents from and against any claim, demand, damage, loss, liability, cost, or expense — including reasonable attorneys’ fees — arising out of or related to your use of the website or services, your violation of these Terms, your Customer Content, or your infringement of any third-party right.

17. Termination

We may suspend or terminate your access to the website or our services at any time, with or without notice, for conduct that violates these Terms or that we reasonably consider harmful to DTF4Prints, our customers, or our business operations. Termination does not affect any order already accepted, or any obligation either of us has already incurred.

18. Events outside our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier delays and service suspensions, equipment or utility failure, supply shortages, labor disputes, severe weather, fire, flood, earthquake, civil unrest, epidemic, or government action.

19. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms, or to your use of the website, products, or services, will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to contact us first and to allow us thirty days to resolve the matter. Most issues are resolved faster and more favorably through direct communication than through a formal dispute.

20. Changes to these Terms

We may update or modify these Terms at any time by posting a revised version on this page and changing the “Last updated” date. Changes apply to orders placed after they are posted, and your continued use of the website constitutes acceptance of the revised Terms.

21. Severability and entire agreement

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will continue in full force and effect. These Terms, together with the policies referenced in Sections 10 and 11 and our Privacy Policy, constitute the entire agreement between you and K&Y, Inc. regarding your use of this website and your orders, and supersede any prior version of these Terms.
